Impugnazione della chiusura dell’account Youtube per misleading informazioni sanitarie (sul Covid19): non ci sono speranze per questo tipo di azioni

Eric Goldman nel suo blog segnala Northern District della California S. Francisco Div. del 4 settrmbre 2023 Case 3:22-cv-05567-LB, Mercola v. Google etc., decide l’istanza di riapetura dell’account , poi corretta in mero accesso per il recupero dei dati, proposta da medico no-vax.

Decide e rigetta, naturalmente. Il modulo contrattuale preparato da Youtube le permette di far cessare senza problemi il rapporto quando c’è vioalazione delle clausole (terms of service o guidelines ) regolanti i contenuti

Nemmeno la buona fede può operare, dato che c’è violazione di un patto specifico

<<The covenant of good faith and fair dealing is implied in every contract and prevents one party from “unfairly frustrating the other party’s right to receive the benefits” of the contract. Guz v. Again, YouTube’s actions were permitted by the Terms of Service. The implied-covenant claim fails for this reason>>.
